CONCERNING
AMENDMENT TO THE REGULATION OF THE MINISTER OF TRADE NO. 10/M-DAG/PER/6/2005
CONCERNING PROVISIONS ON THE EXPORT AND IMPORT OF ROUGH DIAMOND

BY GRACE OF THE ALMIGHTY GOD,
THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering:

• a. that to ensure the smooth export and import of rough diamond, it is necessary to give business certainty to the exporters and importers of rough diamond;
• b. that in relation with the matter in paragraph a, it is necessary to amend Regulation of the Minister of Trade No. 10/M-DAG/PER/6/2005 concerning Provisions on the Export and Import of Rough Diamond;
• c. that based on consideration as described in paragraph a and b, it is necessary to stipulate Regulation of the Minister of Trade;

In view of:

• 1. Trade Law of 1934 (Statute Book No. 86/1938);
• 2. Law No. 10/1995 concerning Customs (Statute Book of the Republic of Indonesia No. 75/1995, Supplement to Statute Book of the Republic of Indonesia No. 3612) that is amended by Law No. 17/2006 (Statute Book of the Republic of Indonesia No. 93/2006, Supplement to Statute Book of the Republic of Indonesia No. 4661);
• 3. Presidential Decision No. 260/1967 concerning Affirmation of Tasks and Responsibility of the Minister of Trade in the Foreign Trade Sector;
• 4. Presidential Decision No. 187/M/2004 concerning the Establishment of the United Indonesia Cabinet that is amended the latest by Presidential Decision No. 171/M/2005;
• 5. Presidential Regulation No. 9/2005 concerning Status, Tasks, Functions, Organizational Structures and Working Arrangements of State Ministries that is amended the latest by Presidential Regulation No. 94/2006;
• 6. Presidential Regulation No. 10/2005 concerning First Echelon Organizational Units and Tasks of State Ministries of the Republic of Indonesia that is amended several time and the latest by Presidential Regulation No. 17/2007;
• 7. Decision of the Minister of Industry and Trade No. 229/MPP/Kep/7/1997 concerning General Provisions in Import;
• 8. Decision of the Minister of Industry and Trade No. 558/MPP/Kep/12/1998 concerning General Provisions in export that is amended several times, lastly by Regulation of the Minister of Trade No. 01/M-DAG/PER/8/2007;
• 9. Regulation of the Minister of Trade No. 10/M-DAG/PER/6/2005 concerning Provisions on the Export and Import of Rough Diamond;
• 10. Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 concerning the Organization and Work Mechanism of the Ministry of Trade that is amended several times lastly with Regulation of the Minister of Trade No. 34/M-DAG/PER/3/2005;

HAS DECIDED:

To stipulate:

REGULATION OF THE MINISTER OF TRADE CONCERNING AMENDMENT TO THE REGULATION OF THE MINISTER OF TRADE NO. 10/M-DAG/PER/6/2005 CONCERNING PROVISIONS ON THE EXPORT AND IMPORT OF ROUGH DIAMOND

Article I

Amend Article 1 paragraph 1 of Regulation of the Minister of Trade No. 10/M-DAG/PER/6/2005 concerning Provisions on the Export and Import of Rough Diamond, so that it reads as follows:

"Article 1

In this Ministerial Regulation:

1. "Rough Diamond" refers to diamond belonging to the classification of Tariff Post/HS as contained in the Indonesia Import Duty Tariff Book of 2007 as follows:

• - 7102.10.00.00 - Not Sorted.
• - Industry:
• - 7102.21.00.00
• -- not worked nor cut simply, split or broken.
• - Non Industry:
• - 7102.31.00.00
• -- not worked nor cut simply, split or broken."

Article II

This Regulation of the Minister of Finance shall come into force as from the date of stipulation.

For public cognizance, this Minister Regulation shall be announced in the State Gazette of the Republic of Indonesia.
